Terms & conditions

1. General

CUSCO CAR HIRE S.A.C. is a licensed car rental agency. By making a reservation, the client agrees to comply with these Terms & Conditions. All rentals are subject to local laws and regulations of Peru.


2. Client Requirements

  • Renters must be at least 25 years old and hold a valid driving license recognized in Peru.
  • Foreign visitors may drive in Peru with their home country license for up to 30 days. After 30 days, a valid international driving permit is required.
  • A valid passport or official identification is required.
  • The client declares they are physically and mentally fit to drive and operate the rented vehicle safely.


3. Booking and Payment

  • Reservations must be confirmed with a 50% deposit, payable via bank transfer, PayPal, or other accepted methods.
  • The remaining balance is due before vehicle pick-up. Payment can be made in cash (PEN or USD) or by credit card (Visa or Mastercard).
  • All bank fees or transfer charges are the responsibility of the client.


4. Cancellation Policy

4.1 Reservation Deposit

  • To confirm a reservation, a 50% deposit of the total rental cost is required.
  • This deposit secures the vehicle for the reserved date.

4.2 Cancellation in Advance

Cancellation Policy

  • More than 7 days before rental:
  • 25% of the deposit will be retained.
  • 75% of the deposit will be refunded.
  • Between 48 hours and 7 days before rental:
  • 50% of the deposit will be retained.
  • 50% of the deposit will be refunded.
  • Less than 48 hours before rental or no-show:
  • 100% of the deposit will be retained.
  • No refund applies.


Note: If the client has paid the full rental amount in advance, the same policy applies: percentages are calculated based on the total amount paid.

4.3 Cancellation due to Force Majeure

  • In cases beyond CUSCO CAR HIRE S.A.C.’s control (accidents, natural disasters, government restrictions), the client will be offered:
  • Rescheduling of the rental, or
  • Full refund of the deposit.

4.4 Notification

  • All cancellations must be made in writing, via email or the official company form.
  • The date and time of the notification determine the applicable refund percentage.

4.5 Optional Cancellation Insurance

  • Clients are advised to purchase cancellation insurance, which may cover losses due to unforeseen events.
  • This insurance is optional and does not replace the deposit.


5. Vehicle Use

  • Vehicles must be driven legally and only by authorized drivers listed on the rental agreement.
  • Off-road driving or use in unsafe conditions is strictly prohibited unless explicitly authorized in writing.
  • The client is fully responsible for any traffic fines, parking tickets, or violations incurred during the rental period.
  • The client is fully responsible for any damage, theft, or loss of the vehicle occurring after the vehicle has been rented.
  • It is strictly prohibited to:
  • Sublease or lend the vehicle to another person.
  • Use the vehicle in races, illegal transport, or any unlawful activities.
  • Drive under the influence of alcohol or drugs.
  • Fuel, tolls, and other charges are the responsibility of the client.
  • Any damage, theft, or loss must be reported immediately. The client is responsible for repair costs not covered by insurance.


6. Insurance and Liability

  • All vehicles include basic insurance. Optional additional coverage is available at extra cost.
  • CUSCO CAR HIRE S.A.C. is not liable for accidents, injuries, or property damage caused by the client’s negligence.
  • Insurance may include deductibles, for which the client is responsible.


7. Third-Party Services

  • Services such as towing, hotel parking, or other third-party providers are independent. CUSCO CAR HIRE S.A.C. is not responsible for any delays, losses, or damages caused by these third parties.


8. Claims and Disputes

  • Any complaints or claims must be submitted in writing within 7 days of the end of the rental.
  • The client agrees that any disputes will be resolved in the courts of Cusco, Peru, under Peruvian law.
  • Liability for any claim is limited to the total rental fee paid.


9. Acceptance of Terms

By completing a reservation and taking possession of the vehicle, the client accepts these Terms & Conditions and agrees to use the vehicle responsibly and legally.
